1. Acceptance and scope

These Terms of Use (“Terms”) govern your use of the Alabama Beach Flag application (the “App”) and its associated public website, support pages, and data-delivery services (together, the “Services”). By downloading or using the App, you agree to these Terms. Informational pages on the public website are provided for reference; these Terms apply to your use of the Services to the extent permitted by applicable law.

2. Informational purpose

The Services provide beach-flag, weather, marine, tide, water-quality, UV, alert, widget, safety, and related coastal information for general informational purposes only. Information may be delayed, incomplete, unavailable, stale, cached, estimated, or inaccurate, and coastal conditions can change rapidly.

No information in the Services is professional safety, medical, weather, marine-navigation, or emergency advice. The App must not be the sole basis for deciding whether to enter or remain in the water.

3. Official, estimated, and unavailable data

Source availability varies by place and type of information. Gulf Shores and Orange Beach may use official local beach-flag information when available. Fort Morgan may display clearly labeled estimated conditions; an estimate is not an official posted flag. Dauphin Island has no accessible official live flag feed, and the App does not fabricate a live flag status. Other independently available Dauphin Island information may still be displayed.

Supporting information can remain available when a beach-flag source is unavailable. Labels and source context are part of the information and should be considered when evaluating it.

Safety comes first

4. On-site authority and emergencies

Posted flags, signs, and current instructions at the beach always take priority over the App. Follow lifeguards, beach patrol, law enforcement, emergency personnel, and local authorities.

The Services are not an emergency service. Call 911 or the appropriate local emergency service for an emergency. Email contacts are not monitored as emergency channels.

5. Independence and attribution

Alabama Beach Flag is independently developed. It is not a government agency or official government app. References to public agencies, local authorities, data providers, or their information do not imply endorsement, sponsorship, partnership, or affiliation.

6. Availability and changes

App functionality, coverage, and data sources may change. Public providers may change, delay, restrict, or discontinue information, and the Services may be interrupted. Alabama Beach Flag does not promise uninterrupted availability. Cached or last-known information may appear when current information cannot be retrieved.

7. User responsibility

You are responsible for exercising independent judgment, checking current on-site conditions, and complying with posted guidance, official warnings, instructions from authorities, and applicable laws. You assume the risks associated with beach, water, weather, and coastal activities.

8. Intellectual property

The original App and website interfaces, branding, graphics, text, and software are owned by or licensed to Alabama Beach Flag and are protected by applicable intellectual-property laws. This provision does not claim ownership of government data, public-domain material, provider content, Apple marks, or third-party names and trademarks, which remain the property of their respective owners.

9. External services and links

The Services rely on or link to public agencies, local authorities, Apple services, and other third-party data or websites. Alabama Beach Flag does not control those external services and is not responsible for their content, availability, security, terms, or privacy practices.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Services and all information they provide are offered “as is” and “as available,” without warranties of any kind, express or implied. Alabama Beach Flag does not warrant that the Services will be uninterrupted, error-free, complete, accurate, reliable, current, or suitable for a particular purpose.

11. Limitation of liability

To the fullest extent permitted by law, Alabama Beach Flag and its developer will not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of, inability to use, or reliance on the Services or their information. This limitation does not apply to liability that cannot lawfully be excluded or limited.

12. Changes to these Terms

These Terms may be revised to reflect changes to the Services or applicable requirements. Revised Terms will be posted on this page with an updated revision date. If a change materially affects use of the App, reasonable notice may also be provided through an appropriate channel. Your use of the App after revised Terms become effective indicates acceptance of the revised Terms to the extent permitted by law.
